Your access to and use of this site is subject to the following terms and conditions and all applicable laws. By accessing and using this site, you accept the following terms and conditions, without limitation or qualification. By using this site you may also subject yourself to the terms and services of Fundraising By Net, LLC and all other affiliate sites. U.S. SALES ONLY
Purchases from the ElectionMall.com are available only in the United States and are not available in any other location. You agree not to use or attempt to use the service from outside of the available territory. ElectionMall Technologies Inc. (EMT) may use technologies to verify such compliance.
SALES TO END USERS ONLY
The ElectionMall Technologies Inc. sells products to end user customers only.
REFUND POLICY
All Sales are final.
DONOR REGISTRATION
Donor Registration is a registered service mark of ElectionMall Technologies Inc., used under license. Donor Registration is a convenient feature that allows you to purchase from the ElectionMall Shopping, online store, with a single click of your mouse without retyping information. Once you have activated donor registration features, clicking the "Buy Now" button will start the download immediately and complete your purchase transaction without any other steps.
PAYMENT METHODS
EMT accepts credit cards and EMT Gift Certificates as forms of payment. If a credit card is being used for a purchase, EMT obtains a pre-approval from the credit card company for the amount of the order. Billing to your credit card occurs at the time of purchase. If the balance from an EMT Gift Certificate is used for an EMT Purchase, the amount is deducted from your account at the time of purchase. If the total amount of the purchase is greater than the balance available in your Gift Certificate or Allowance Account, your credit card will be charged for the balance.
EMT accepts the following credit cards: Visa, MasterCard, American Express, and Discover.
PLEASE NOTE:
- We are unable to accept credit cards issued by banks outside of the United States.
- Debit cards and check cards have daily spending limits that may prevent the processing of your order.
- If a purchase has been declined online due to credit card issues, please ensure all data is correct and resubmit. If the transaction is not accepted online, you will be unable to use that card for your purchase and should use another credit card.
BILLING
If you are purchasing using ElectionMall Membership, part of the Donor Registration, your order may be authorized and billed in gradual increments during one purchasing session as you click the "Buy Now" button. Depending on the size of your order, this may appear as multiple orders and billings on your credit card statement.
If you use the Shopping Cart functionality, you will have one order that authorizes and bills as a single purchase.
SALES TAX
EMT purchases will include sales tax based on the bill-to address and the sales tax rate in effect at the time of download. If the sales tax rate for the billing address changes before the song is downloaded, the new tax rate in effect at the time of download will apply. We will only charge tax in states where music downloads are taxable. No customers are eligible for tax exemptions for purchases made on the ElectionMall.com.
GIFT CERTIFICATE PURCHASES
Gift Certificates may be redeemed for EMT purchases only and are non-refundable. They cannot be used for purchases on the ElectionMall.com Online Store. Sales tax will not be charged when the Gift Certificate is purchased. Sales tax is charged when the Gift Certificate is redeemed for an Tunes Music Store purchase. The tax rate on the purchase is based on the address of the redeemer (see Tax section for more information). Purchases for Gift Certificates may be purchased only in whole dollar increments or designated amounts. Gift cards do not have expiration dates. Gift Certificates may not be used to purchase other Gift Certificates.
Gift certificates, allowances, and unused portions of gift certificates and allowances, expire the later of, two years from the date of issuance, or two years from the date of last activity if applied to an EMT Account. Expiration does not apply in California, Maine, or Massachusetts, or in New Hampshire for gift certificates or allowances over $100, or in any other state where prohibited by law.
PRICES
EMT endeavors to offer you competitive prices on current selections. Your total price will include the price of the product plus any applicable sales tax (in effect on the day of download). EMT reserves the right to change prices for products offered at the EMT at any time, and does not provide price protection or refunds in the event of a price drop or promotional offering.
MUSIC AVAILABILITY
EMT makes every effort to provide a broad music offering. For this reason, EMT reserves the right to change music options without notice.

CONTENT USAGE RULES
Your use of the Products is conditioned upon your prior acceptance of the terms of this Agreement.
You shall be authorized to use the Product only for personal, non-commercial use.
You shall be authorized to use the Product on authorized computers.
You shall be entitled to burn and export data Products solely for personal, non-commercial use.
Any burning or exporting capabilities are solely an accommodation to you and shall not constitute a grant or waiver (or other limitation or implication) of any rights of the copyright owners of any content, sound recording, underlying musical composition or artwork embodied in any Product.
You agree that you will not attempt to, or encourage or assist any other person to, circumvent or modify any software required for use of the Service or any of the Usage Rules.
The delivery of a Product does not transfer to you any commercial or promotional use rights in the Product.

OTHER TERMS AND CONDITIONS
EMT is not responsible for typographic errors.
EMT reserves the right to change the terms and conditions of sale at the ElectionMall Technologies Inc. at any time. Customers are encouraged to review the Sales Policies on a periodic basis for modifications.
All sales on the EMT are governed by Illinois law, without giving effect to its conflict of law provisions.
No EMT employee or agent has the authority to vary any of the ElectionMall Technologies Inc. policies or the terms and conditions governing any sale.
